Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy ("AUP") sets out the rules for using the services DITAP (Inversiones Tecnomagallanes SpA — Chile — and its current or future affiliated entities or legal representations in the other countries where it operates) operates for you or your end users, in particular:

  • Managed connectivity and professional WiFi services (WiFiAtlas and networks we administer for hotels, offices and remote operations).
  • Network infrastructure we operate or monitor on the client's behalf (cabling, switches, access points, firewalls).
  • Remote access and credentials DITAP manages to deliver managed support.
  • This AUP is an annex to our Terms and Conditions (ditap.io/en/terms) and applies alongside the specific services agreement. In the event of a conflict, the signed services agreement prevails.

    2. Who it applies to

    It applies to our contracting client and to anyone using the network or infrastructure we operate on their behalf: employees, guests, contractors and visitors. The contracting client is responsible for communicating this policy to their end users where relevant (for example, guests at a hotel with WiFi managed by DITAP).

    3. General prohibited uses

    You may not use the services we operate to:

  • Engage in illegal activity under the laws of Argentina, Chile, Italy or the European Union, as applicable.
  • Distribute malware, ransomware, viruses, or any code designed to damage systems belonging to us or third parties.
  • Send spam or unsolicited bulk commercial communications.
  • Engage in phishing, identity spoofing, or any form of fraud.
  • Access systems, networks or data of third parties without authorization.
  • Infringe third parties' intellectual property rights.
  • Intercept or attempt to intercept other users' communications on the network.
  • 4. Acceptable use of connectivity services

    For WiFi and connectivity networks we manage:

  • Fair use of bandwidth: bandwidth is a shared resource. Hogging capacity in a way that degrades service for other users on the same network is not allowed (for example, sustained mass downloads or cryptocurrency mining without the contracting client's express authorization).
  • No launching attacks from the network: you may not use the network to originate denial-of-service attacks (DoS/DDoS), unauthorized port scanning, or any activity that compromises network availability for others.
  • No unauthorized resale: you may not resell or redistribute the contracted connectivity service to third parties without DITAP's prior written agreement.
  • Segmentation: where the network design includes VLANs or SSIDs separated by purpose (for example, a guest network vs. an operational network), attempting to bypass that segmentation is prohibited.
  • 5. Acceptable use of managed infrastructure and services

    When DITAP operates infrastructure or has remote access to a client's systems to deliver managed support:

  • Access is limited to the scope defined in the services agreement (for example, network monitoring, switch administration, firewall management).
  • DITAP does not access systems, applications or data outside the contracted scope without express authorization.
  • Access credentials are for the exclusive use of authorized DITAP personnel and are subject to the security measures described in Section 8 of our Data Processing Agreement (ditap.io/en/legal/dpa).
  • The client is responsible for keeping the list of systems and data included in the service scope up to date.
  • 6. Prohibited content

    In addition to Section 3, on networks managed by DITAP with internet access, it is further prohibited to use the network to host, distribute, or access:

  • Content that infringes copyright without authorization (including P2P networks used for that purpose).
  • Child exploitation content, under any circumstances — detection triggers immediate reporting to the competent authorities.
  • Content that incites violence, hatred or discrimination under applicable law.
  • DITAP may apply reasonable technical filtering (for example, blocking known malicious domains) as part of normal network operation, without this constituting an obligation to actively monitor the content of users' communications.

    7. Security and monitoring

    DITAP may monitor network traffic and technical logs (metadata, volume, IP addresses, security events) for the purpose of:

  • Detecting and mitigating attacks, malware or network abuse.
  • Ensuring the quality and availability of the contracted service.
  • Complying with legal obligations or requests from competent authorities.
  • This technical monitoring is carried out in accordance with our Privacy Policy (ditap.io/en/privacy) and does not involve inspecting the content of communications unless required by law or justified by an active security threat.

    8. Consequences of breach

    In the event of a breach of this AUP, DITAP may, depending on severity and at its reasonable discretion:

  • Warn the contracting client and request immediate cessation of the conduct.
  • Temporarily suspend access to the network or affected service, prioritizing the security of other users.
  • Terminate the service, in accordance with the termination grounds in our Terms and Conditions (ditap.io/en/terms), with no obligation to refund where the breach is attributable to the client or its end users.
  • Report the conduct to the competent authorities where legally required (for example, on evidence of criminal activity).
  • Whenever reasonably possible, DITAP will notify the client before suspending service, unless there is an immediate security threat requiring action without delay.

    9. How to report abuse

    If you detect misuse of a network or service operated by DITAP — your own, another user's, or an intrusion attempt — report it to [email protected] with as much detail as possible (date, time, IP address or device involved, description of the incident).

    10. Changes to this policy

    We may update this AUP to reflect changes in our services or applicable regulations. Significant changes will be communicated to the contracting client and reflected in the "Last updated" date at the top of the document.
